TERMS AND CONDITIONS

Please take the time to review WILDLAND’s Terms and Conditions. By booking a photo tour, or registering for a workshop, you acknowledge and agree to the requirements set forth in this Agreement.

  1.  BOOKING

    To book a photo tour/workshop organized by WILDLAND PHOTO TOURS (referred to as “WILDLAND”), registration must be completed through the online booking system on www.wildlandphototours.com. The booking is confirmed upon receipt of full payment, you will receive a confirmation email, including invoice. You will be required to sign a Waiver of Liability and Release prior to participating in the photo tour/workshop. A print out will be provided at the start of the photo tour/workshop.

  2.  ELIGIBILITY

    The booking person must be 18+ years of age when requesting a photo tour/workshop. All participants under the age of 18 must be accompanied by a parent or legal guardian for the entire duration of the photo tour/workshop.

  3. INCLUDED

    All photography instruction and sharing of in-depth local knowledge of the landscape, wildlife and weather patterns of Jasper National Park by WILDLAND’s photo guide and instructor is included in the price of a photo tour/workshop. We will be in touch by email, to discuss the itinerary, subject matter and any personal requests. The itinerary of a photo tour/workshop is only planned and is never guaranteed. Instruction during photo tours/workshops will be provided on a case-by-case basis judged on the abilities and requests of the participant(s).

  4. EXCLUDED

    WILDLAND’s pricing only covers the services listed above. Should additional expenses arise during the photo tour/workshop, the booking person will be responsible for such expenses. Without limiting the foregoing, following items are excluded from the price; personal travel insurance; any visa, passport and vaccination charges; all transportation and accommodation costs; valid National Park passes, regardless of the mode of travel; all medical expenses; emergency evacuation, evacuation by helicopter, and/or emergency search charges; additional expenses caused by delay, accidents or disruption of planned itinerary; gratuities, food and drinks.

  5. PRICING

    Pricing on WILDLAND’s website are the current prices and are listed in Canadian Dollars (CAD), including GST charges (5% in Alberta), transaction fees and Destination Marketing Fees (3% DMF). WILDLAND reserves the right to amend pricing without notice prior to the photo tour/workshop date. Amendments shall not be retroactively applied or held for future credit.

  6. PAYMENT

    Prices are payable by credit card (through Stripe and PayPal) or bank e-transfer.

  7. CANCELLATION AND REFUND POLICY

    Photo tours come with a 7-day cancellation policy. A full refund, minus $35 admin fee, will be provided when canceling the photo tour more than 7 days prior to the planned tour date and time. Sorry, no refunds will be issued with less than 7 days notice.

    Workshops run with a minimum of 3 participants and a maximum of 8 participants. All spots are non-refundable but are transferable to a new participant (full refund, minus $35 admin fee). We keep a wait list, but a transfer is never guaranteed.

    Refunds will be issued within 10 business days.

  8. DURATION

    The duration of any particular photo tour, as well as the exact date and time for workshops, is indicated on WILDLAND’s website. This time frame starts on the planned meeting time, at the confirmed start location. Included in the duration of the photo tour/workshop is the time in the field, including hiking to the location, scouting for composition and gear set-up, as well as time spent on the road to, and in between locations.

  9. CAMERA EQUIPMENT AND SKILL LEVEL

    WILDLAND’s photo tours/workshops are tailored to the skill level of the participant(s), from first-timers to seasoned professionals, and are suitable to anyone with a digital camera (DSLR or mirrorless) with manual control of shutter speed, aperture and ISO settings. Photography equipment is NOT included in the photo tour/workshop. It is your responsibility to ensure your camera and lenses are in working order.

  10. WILDLIFE

    Wildlife is abundant in Jasper National Park and will be treated with utmost respect. A wildlife encounter is never guaranteed and specific requests to view and photograph wildlife may not be fulfilled. When a wildlife encounter allows for a safe experience, for both human and animal, we will have the opportunity to photograph the animal. We will remain in our vehicles at all times, as is stated in Parks Canada’s wildlife viewing practices.

  11. WEATHER

    All photo tours/workshops run in adverse weather, unless a Public Alert has been published by Environment Canada. In that case, a full refund, minus $35 admin fee, will be provided.

  12. WILDFIRE SMOKE

    In recent years we have experienced periods with severe wildfire smoke. Photography can be challenging in these conditions, and often make for a rather disappointing experience. WIDLAND strives for flexibility and in case of cancellation due to unhealthy smoke conditions (AQHI rating of 7+ by Environment Canada) a full refund, minus $50 admin fee, will be issued. Even beyond the 7-day cancellation policy.

  13. HEALTH & FITNESS

    You must be in good health, physically and mentally, to participate in a photo tour/workshop. Evacuation and all associated expenses are your sole responsibility. WILDLAND reserves the right to amend the itinerary based on medical or fitness grounds. Participation in a photo tour/workshop remains at your own risk entirely.

  14. MEDICAL DISCLOSURE

    You agree to and warrant that:

    • You are in good health, physically and mentally by the time of booking

    • You have disclosed to WILDLAND any concerning health and fitness matters

    • You will immediately notify WILDLAND upon changes in your health or fitness

    • You have taken out travel insurance, with appropriate coverage for potential medical issues and pre-existing medical conditions

  15. INSURANCE

    Personal travel insurance is NOT included in the photo tour/workshop price. It is a booking requirement, and your responsibility to ensure that you are insured for the full duration of the photo tour/workshop, including for illness, injury, death, loss or damage of baggage, camera equipment, personal items and cancellations. WILDLAND is not responsible for verifying adequate insurance coverage.

  16. ACCOMMODATION

    Accommodation is NOT included in the photo tour/workshop price. WILDLAND strongly recommends organizing accommodation prior to booking a photo tour/workshop.

  17. TRANSPORTATION

    Transportation is NOT included in the photo tour/workshop price. Participants agree to arrange proper transportation for the photo tour/workshop, this includes insurance coverage, a valid National Park pass and the use of winter tires when required. Any additional costs are the sole responsibility of the owner of the vehicle. WILDLAND strives for sustainability, carpooling is strongly encouraged with 1-2 participants.

  18. ITINERARY CHANGES, CANCELLATION OR DELAY

    Itineraries are shared in good faith, with the intention to visit locations and capture particular scenes. You acknowledge that changes, postponements, delays or disruptions of planned itineraries may occur and you shall be responsible for any associated additional expenses.

    WILDLAND reserves the right to cancel a photo tour/workshop prior to the scheduled starting time, in which case a full refund, minus $50 admin fee, will be issued within 10 business days.

  19. ASSUMPTION OF RISK

    You acknowledge and agree that:

    • WILDLAND’s photo tours/workshops will take place in remote locations and may partake in challenging weather conditions, and may include a higher level of risk than conventional tours, and included potential exposure to injury and possibly death

    • Additional risks associated with a photo tour/workshop may include difficult and dangerous terrain, extreme weather conditions, remoteness from regular medical and communication services, and evacuation difficulties in the event of illness or injury

    • The enjoyment of a photo tour/workshop is party in due to the risks and limitations of remote locations

    • You accept the inherent and increased risks associated with the proposed photo tour/workshop and the accompanying risk of injury, death or property damages or loss

  20. CODE OF CONDUCT

    Participants of WILDLAND’s photo tours/workshops are expected to conduct themselves in a respectful and responsible manner, including adhering to the rules and regulations set by Parks Canada in Jasper National Park. Any use of illegal drugs or substances, committing or participating in unlawful activities, violence, disrespect or breaking Parks Canada’s rules and regulations, will result in the immediate removal of the participant from the photo tour/workshop, without refund and at the expense of the participant.

  21. RELEASE OF LIABILITY

    By registering for a WILDLAND photo tour/workshop you acknowledge that you have read and understand WILDLAND’s Terms and Conditions, Disclaimer and Privacy Policy as well as the date, time and meeting location. You acknowledge and accept the additional inherent risks associated with the photo tour/workshop, and you release, waive and discharge WILDLAND and its photo guides, instructors, representatives and employees from any and all responsibility or liability for any and all claims, actions or losses, expenses, personal injury including death, property damage, loss of services, loss of profits and indirect damages, that you or your next of kin may suffer. Which may arise during your travel, in direct connection with the photo tour/workshop or in connection with any optional activities which you may undertake during the photo tour/workshop.

    Photo tour/workshop participants are required to sign a Waiver of Liability and Release, which will be provided at the start of the photo tour/workshop. It is imperative that you read, understand and sign the waiver. Should you refuse to sign, you will not be permitted to participate in the photo tour/workshop and you will not be entitled to refund, credit or transfer.

  22. LIMITATION OF LIABILITY

    The maximum total liability of WILDLAND in connection with a photo tour/workshop booking shall be limited to the amount of fees actually paid by you to WILDLAND. In no event shall WILDLAND be liable for any indirect damages including loss of time, inconvenience, flight changes or cancellation fees, or any other cost or damages associated with transportation, accommodation and other travel costs.

  23. PRIVACY

    You permit WILDLAND to collect personal information from you regarding your health and medical condition. You acknowledge that this personal information may be disclosed to WILDLAND representatives, or medical personnel in the event of emergency, in order to ensure your safety and well-being. Your personal information will not be used by WILDLAND for any other purpose without your consent.

  24. MODEL AND PHOTO RELEASE

    WILDLAND and its designated representatives reserve the right to take photographs and videos during the photo tour/workshop to capture content for promotional and commercial purposes. You acknowledge and agree that WILDLAND and its designated representatives are allowed to use the content without notice and compensation to the participant.

    WILDLAND agrees that copyright in all photography and video content created by the participant during a photo tour/workshop, shall belong to the participant upon creation. The participants grants WILDLAND and its designated representatives a non-exclusive, worldwide, irrevocable license to use voluntarily provided content by the participant in any media for editorial use, promotion and advertisement of WILDLAND’s photo tours and workshops, including by sharing/tagging content on social media.

  25. WAIVING OF RIGHTS

    WILDLAND will NOT be deemed to have waived any of its rights under this Agreement or at law, by allowing any time or indulgence or by not exercising any right or remedy arising out of any default by the participant(s).

  26. SEVERANCE OF CONDITIONS

    If any part of a term condition herein is found to be illegal, unenforceable or invalid, it is to be treated as removed from the Terms and Conditions, however the remainder of the terms and conditions remain valid, binding and unaltered.

  27. JURISDICTION

    This Agreement and the rights and obligations of the parties will be governed and take effect in accordance with the laws of the Province of Alberta and the laws of Canada applicable. 

 

WILDLAND’s Terms and Conditions may be amended without further notice.
